The petitioner is apprehending his arrest in connection with Mohania P.S.Case No.163 of 2019 registered for the offence punishable under Sections 379 and 411 of the Indian Penal Code.

From perusal of the FIR, it appears that petitioner is involved in commission of crime of stealing trucks loaded with rice.

It is submitted on behalf of the petitioner that the petitioner is not named in the FIR. It is further submitted that the petitioner has been made accused on the basis of confessional statement of co-accused Arvind Kumar Pal and nothing has been recovered from the conscious possession of

Patna High Court CR. MISC. No.40606 of 2019(4) dt.11-09-2019 2/2 the petitioner. Save and except, there is no incriminating material against the petitioner. It is further submitted that police raided the house of petitioner but no incriminating material has been recovered from the house of the petitioner. Considering the facts aforesaid, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua/successor Court in connection with Mohania P.S.Case No.163 of 2019/G.R.No.722 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
