The petitioner seeks bail in Sadar P.S. Case No. 402 of 2018 registered under Section 457/380 of the Indian Penal Code.

Some gold and silver ornaments and cash of Rs.25,000/- are said to have been stolen by some unknown miscreants from the house of the informant in the night. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner is not named in the F.I.R. The article seized from the possession of the petitioner is not the stolen one & it does not match with the

Patna High Court Cr.Misc. No.49669 of 2018 (03) dt.20-09-2018 - 2 - stolen article rather the aforesaid article is hailing to the petitioner. The aforesaid seized article has also not been put on T.I.P. Chargesheet in the case has already been submitted. Petitioner has no criminal antecedent and has been languishing in custody since 20.02.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S. Case No.402 of 2018.
