The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324 and 307/34 of the Indian Penal Code. Subsequently, section 302 of the IPC was also added. The prosecution case is that the petitioner and other co-accused persons variously armed entered into the house of the informant and assaulted the informant. The further case of the prosecution is that when the husband of the informant Karu Ram came he was also assaulted by petitioner and others. One Bidan Ram was also assaulted. Subsequently, the husband of the informant succumbed to the injuries.
Patna High Court Cr.Misc. No.42952 of 2015 (2) dt.16-10-2015 2/2 It is submitted by learned counsel for the petitioner that the accusation is omnibus and general. The petitioner is 80 years of age having no criminal antecedent. Statements to that effect have been made in paragraphs 3 and 16 of the petition and the post-mortem reflects only one injury. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Surajgarha P.S. Case No. 90 of 2015 pending in the court of learned Chief Judicial Magistrate, Lakhisarai.
With the aforesaid observation, this application is disposed of.
