In this case, the petitioner is seeking anticipatory bail in connection with Mohania P.S. Case No. 169 of 2019 registered for offence punishable under sections 420, 467, 468, 401, 413, 411, 120 (B) of the Indian Penal Code. As per the allegation made in the fardbeyan by the informant himself, he was investigating in Mohania P.S. Case No. 163 of 2019 for offence under section 379 of the Indian Penal Code in which allegation has been made that some persons connived under conspiracy committed theft of the truck along with rice. The second truck was recovered from Buxar, but rice was already unloaded. Both the trucks were recovered and seizure list was prepared. In CCTV footage, one

No.39208 of 2019(2) dt.27-06-2019 2/2 "Scorpio" vehicle was identified and on that basis, its driver was arrested and two persons were later on arrested and they have disclosed that they are involved in committing theft of rice and selling the same. Again the truck was also stolen and the same was recovered. The driver has taken the name of this petitioner to be involved in that crime.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below without being prejudiced by this order, will take decision in accordance with law.
