The petitioners are apprehending their arrest in a case registered for the offence punishable under sections 364A/34 of the Indian Penal Code.

On abduction of the son of the informant, namely, Manish Kumar Pandey @ Rajeev Kumar Ranjan, First Information Report was lodged against unknown. During investigation Jitu Mandal @ Jitendra Mandal and Bithal Yadav were arrested. From the recovered mobile of the apprehended accused it was found that at the relevant point of time they talked with the petitioner. Hence, the police suspected that the petitioners facilitated the commission of offence.

It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.25571 of 2016 (2) dt.27-06-2016 that only on suspicion the accusation has been levelled as mobile number on which the apprehended accused made calls were not identified/ verified during investigation. Moreover, co-accused Bethal Yadav @ Bithal Yadav and Jitendra Mandal have been granted regular bail by a co-ordinate Bench of this Court. Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Sikandra P.S.Case No. 81/2015 pending in the court of Addl. Chief Judicial Magistrate II, Jamui. With the aforesaid observation, this application is disposed of.
