The petitioner, already in custody, seeks bail in connection with Bhorey P.S.Case No. 24 of 2018 registered under Sections 413, 414, 420, 467 and 468 of the Indian penal Code.

Allegation in brief is that two persons Ajay Rai and Jhuna Pandey were apprehended by the police with stolen motorcycle, they disclosed before the police regarding involvement in committing theft and selling stolen motorcycles and also disclosed that one motorcycle was in possession of the petitioner and the same was recovered. .

Submission is that petitioner purchased the motorcycle from Ajay Rai and had no knowledge that it was stolen motorcycle and still he was taking time for transferring

Patna High Court Cr.Misc. No.26336 of 2018(5) dt.02-08-2018 2/2 motorcycle in the name of the petitioner but in the meantime recovery was made but there is no allegation against the petitioner of committing theft and has been in custody for last six months approximately.

Learned counsel for the State also submits that motorcycle, as per the allegation, was purchased by the petitioner from Ajai Rai and this fact is revealed in the case dairy.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Uma Shankar Baitha, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-XII, Gopalganj in connection with Bhorey P.S. Case No. 24 of 2018.
