2. The petitioner has preferred this application for grant of regular bail in connection with Sadar P.S. Case No. 801 of 2023 dated 17.08.2023 registered for the offences punishable under Sections 356 and 379 of the Indian Penal Code.

3. As per the prosecution case, two unknown miscreants boarded on motorcycle snatched Rs. 8 lakhs from the informant and fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. The petitioner is not named in the FIR but the name of the petitioner has sprung up in this case in the confessional

Patna High Court CR. MISC. No.44104 of 2024(2) dt.08-08-2024 2/2 statement of co-accused person. The petitioner was remanded in this case from Sadar P.S. Case No. 803 of 2023. The recovery was made from the lodge of co-accused, Arvind Kumar. The co-accused, Sanjay Kumar @ Sanjay Banjara has been granted bail by this Court vide order dated 22.07.2024 passed in Cr. Misc. No. 45948 of 2024. The petitioner has no concern with the alleged recovery. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 18.10.2023.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Muzaffarpur in connection with Sadar P.S. Case No. 801 of 2023.

7. The application stands allowed.
