2. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 323, 325, 427 and some other ancillary Sections of the Indian Penal Code.

3. As per the prosecution case, this petitioner assaulted Kamlesh Kumar with rod on his head.

4. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that both parties are agnates and next door neighbour and due to minor dispute over storage of stone chip for the construction of common road, scuffle took place in which Kamlesh sustained injury. Petitioner has got clean antecedent.

5. Learned counsel appearing for the State opposes

6. Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Nawada in connection with Narhat PS case No. 19/ 2023, subject to conditions laid down u/s 438(2) of the Cr. P. C.
