The petitioner apprehends his arrest in connection with Excise Case No. 101 of 2019, registered under Section 30 (A) of the Bihar Prohibition and Excise Act, 2018. The accusation is that on receiving secret information about selling of illicit liquor by the petitioner. The informant and other officials of Excise Department raided the petitioner's shop. On seeing the informant and other police personnel, the petitioner succeeded to flee away. Thereafter, search was made in the shop of the petitioner and 384.840 litres of Indian made foreign liquor was recovered which was kept hidden in his shop.

Patna High Court CR. MISC. No.39728 of 2019(2) dt.28-06-2019 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner was not a vendor of illicit liquor, rather, the shop was searched in his absence.

Having regard to the facts and circumstances of the case and recovery of huge quantity of illicit liquor from the shop of the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, his prayer for grant of anticipatory bail stands rejected.
