KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with N.H. Bangara P.S. Case No. 46 of 2017 registered for the offence punishable under Section 414 of the Indian Penal Code and 25 (1-B)A/26/35 of the Arms Act.

The allegation against the petitioner is that one loaded pistol, two cartridges and one mobile were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that he is quite innocent and has committed no offence and the petitioner has been falsely been implicated in this case. No arms and cartridges have recovered from the possession of the petitioner and

Patna High Court Cr.Misc. No.44803 of 2017 (2) dt.20-09-2017 the alleged motorcycle is not a theft motorcycle and he is in custody since 23.05.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Samastipur, in connection with N.H. Bangara P.S. Case No. 46 of 2017.
