The petitioner seeks bail in anticipation of his arrest in connection with Govindganj (Malahi) P.S. Case No. 192 of 2021, instituted for the offences under Section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that recovery of liquor has been made from the house of co-accused, Ramesh Yadav. In view thereof, the case under Section 30(a) of the Excise Act would, therefore, not lie as against the petitioner. I have considered the submission.

Taking into consideration the aforesaid facts, I am
