The petitioner seeks regular bail in connection with Nathnagar (Madhusudanpur) P.S.Case nO.403 of 2017 registered for offences punishable under Sections 364(II)/34 of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the brother of the informant and demanding Rs.1.5 lac as extortion. Submission of the learned counsel for the petitioner is that name of the petitioner transpired on the statement of one Santodh Kumar Mandal, who has been granted bail by this Court, vide order dated 26.9.2018 passed in Cr. Misc. No.41503 of 2018. The petitioner is in custody since 5.3.2018.
Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.50212 of 2018 (2) dt.31-10-2018 2/2 bail stating that in the statement recorded under Section 161 of the Cr.P.C., the victim boy has taken name of the petitioner and Santosh Kumar Mandal also and he has also stated that he was assaulted.
Having heard both sides and in view of the fact that the petitioner is in custody for eight months and the charge sheet has already been submitted, as such, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Bhagalpur in connection with Nathnagar (Madhusadanpur) P.S.Case No.403 of 2017 with condition that he has to co-operate in disposal of the trial otherwise his bail bond shall be cancelled.
