JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Informant, who happens to be father of Kanti Kumari, had filed written report alleging inter alia that Kanti was married with Suraj Kumar about five years ago. She had begotten a son out of aforesaid wedlock. In due course of time, she was being dealt with cruelty over which, he was informed. He came to sasural of his daughter and tried to pacify the matter. However, her son-in-law and other family members demanded Rs.50,000/- for doing business. On account of financial crunch, he declined, whereupon they threatened that his daughter will not be allowed to remain in good harmonious atmosphere. Subsequently thereof, on 25.06.2017, he was informed regarding murder of his daughter,

Patna High Court Cr.Misc. No.47979 of 2017 (02) dt.17-10-2017 whereupon he along with others came and found dead body of his daughter kept inside a 'Kothi'. He informed the police. Police came, took out dead body from the 'Kothi. He had found severe ante-mortem injuries over the person of his daughter. On query, he came to know from the villagers that his daughter was murdered by her husband Suraj Kumar, Dewar Chand @ Chandan Kumar along with their friends, Vikram, Jitendra Kumar (petitioner) and others.

From the order impugned, it is evident that husband of the deceased had confessed his guilt as is evident from Para-20 of the case diary.

Considering the nature of the evidence, petitioner Jitendra Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P. S. Case No.407 of 2017.
