The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 427 and 504 of the Indian Penal Code.
The explanation of the Superintendent of Police, Begusarai at flag 'C' in pursuance of order dated 28.11.2018 is accepted.
Though allegation against the petitioner is of commission of injury at the forehead of Sunil Kumar Yadav but the Doctor has not found any injury on the person of Sunil Kumar Yadav.
Learned counsel for the informant opposed the prayer
Patna High Court Cr.Misc. No.50826 of 2018(4) dt.10-12-2018 2/2 for anticipatory bail.
Considering the fact that prosecution allegation is not corroborated by the medical report, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Khodabandpur (Chhourahi O.P.) Police Station Case No. 176 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
