Petitioner seeks bail in Shakurabad P.S. Case No. 99 of 2017 registered for the offences punishable under Sections 364/34 of the Indian Penal Code.

Informant has alleged that the petitioner and one accused had kidnapped his brother and even after search, he could not be located and, thereafter, instituted the first information report.

Kidnapped person has returned and his statement has been recorded under Section 164 of Cr.P.C. in which he has stated nothing against the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail

Patna High Court Cr.Misc. No.50780 of 2018(3) dt.29-11-2018 2/2 upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jehanabad in connection with Shakurabad P.S. Case No. 99 of 2017 with following conditions:- (1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
