JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-10-2022 The present writ petition has been filed for payment of the retiral dues of the petitioner who retired on 31.01.2021, while posted as Incharge Headmaster at Harivansh Narayan Inter College, Mahaddipur, Bandehara, Khagaria. The learned Additional Chief Secretary, Education Department, Government of Bihar, Patna, is present and has submitted that the entire amount of Leave Encashment, Group Insurance and G.P.F. has already stood paid apart from 90%

As far as the balance amount of pension and gratuity amount is concerned, it is submitted that the petitioner had received certain amount of fees from the students amounting to a sum of Rs. 5,32,232/- which he had not deposited in the account of the State Government, hence the pension and gratuity amount have not been finalized. Nonetheless, it is submitted that 100% pension and 100% gratuity amount would be paid to the petitioner after deducting the said sum of Rs. 5,32,232/- within a period of two weeks from today. As far as the aforesaid amount of Rs.

5,32,232/- is concerned, it is submitted that the petitioner and one other person are being heard and final decision with regard to the same shall be taken after considering the documents submitted by the petitioner and upon making enquiry from the field level, within a period of four weeks from today. Having regard to the aforesaid stand taken by the respondents, the present writ petition stands disposed off, in terms, thereof.
