JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The prosecution case is of killing the sister of the informant within six months of the marriage for non-fulfillment of the dowry demand and disposing of the dead body. It is alleged against the petitioner that the petitioner was sitting at the victim's in-laws house on the alleged date of occurrence and also participated in the cremation.
It is submitted by learned counsel for the petitioner that the petitioner is the uncle of the informant and he is on serious litigated terms with the informant as Ramgarhwa P.S. Case No. 42 of was earlier registered from
Patna High Court Cr.Misc. No.41967 of 2015 (2) dt.14-10-2015 2/2 the petitioner's side against the informant hence, maliciously the petitioner has been roped in the present case. Considering the fact that the petitioner is not the family members of the husband of the victim and thrust of accusation is against the in-laws family members of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Raxaul at Motihari in connection with Adapur (Nakardei) P.S. Case No. 107 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
