Petitioner, who is in custody, seeks bail in connection with Special (N.D.P.S.) Case No. 7 of 2019 arising out of F.No. NCB/PZU/V/4/2019 registered for the offence punishable under Sections 8/20/25/29 of N.D.P.S. Act. Allegation is recovery of 828 Kgs of Ganja from the truck in which petitioner and other person Raj Kumar was sitting. Petitioner has confessed his involvement in his statement recorded under Section 67 of N.D.P.S. Act.

It has been submitted on behalf of petitioner that in the seizure list as contained at page No. 12, the recovery of the Ganja has been shown from the possession of driver cum owner

Patna High Court CR. MISC. No.41469 of 2019(5) dt.27-09-2019 2/2 of the truck Raj Kumar and not from the possession of petitioner.

Considering the huge amount recovered from the truck, I am not inclined to grant bail to the petitioner at this stage. Accordingly this application is dismissed. (S. Kumar, J) veena/- U T
