2. The present petition has been preferred for the grant of following relief(s):
(i) For directing and commanding the respondent to quash the subsequent registered
2/4 sale/gift deeds bearing deed number 29050 & 29059 (Annexure-P/2 & Annexure-P/3) dated 25.10.2023, executed by respondent no. 6 & 8 in favour of respondent no. 7 & 9 respectively and remove them from official land records, which was registered in the office of respondent no.4, after the petitioner's registered gift deed bearing deed no. 29025 (Annexure-P/1) dated 25.10.2023, for the same land.
(ii) Also for directing and commanding the respondent authorities to take appropriate action for cancellation of the later deeds i.e. deed number 29050 & 29059 (Ann-P/2 & Ann- P/3) as per Registration Act.
(iii) Also issue a direction to the revenue authorities to proceed with mutation in favour of the petitioner based on his first valid registered gift deed (Annexure-P/1).
(iv) And also issue direction to the respondent authorities to conduct a proper inquiry into the legality of the registrations.
(v) And also dispose of her representation dated
3/4 2.1.2025 (Ann-P/4) filed before respondent no.-3 with reasoned order as earliest.
(vi) And also, for any other relief/ relieves for which petitioner is found to be legally entitled under the facts and circumstances of the case.
3. The matter relates to the land as incorporated in paragraph no.5 and read as under:
"That Mosmat Ramkumari Devi wife of late Bharath Shahi, resident of village- Anant Kamtaul, P.S.-Kurhani, District-Muzaffarpur, who has exclusive titled and possession over that land in question after mutual partition, gifted a plot amounting to Rs. 7,04,000/- bearing its area 8 decimel situated at revenue village-Anant Kamtaul, Thana no. 178, Halka Chandrahatti, Anchal-Kurhani, bearing new Khata no. 123, New Khesara no. 1097, through registered gift deed no 29025, in favour of the petitioner Priti Kumari on dated 25.10.2023."
4. Learned counsel for the petitioner submits that despite the land belonging to them, it has been registered which
4/4 has greatly affected them.
5. After some argument, learned counsel for the petitioner submits that the petitioner shall be approaching District Registering Officer-cum-Registrar, Muzaffarpur (respondent no.4) in next four weeks alongwith all the valid documents.
6. If the petitioner approaches the concerned respondent no.4, he/she shall be duty bound to take up the matter, issue notice to the affected parties and after hearing them to take the matter to its logical conclusion within a period of four months from the date the petitioner approached the said respondent.
7. The writ petition stands disposed of with the aforesaid observation.
8. If any Interlocutory Application is pending stands disposed of.
