1. Heard learned counsel for the petitioner and learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109, 303(2), 352, 351(2), 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that 15.03.02026 at 05:00 PM the accused persons including the petitioner came and petitioner assaulted him by rod causing injury on hand and repeated the blow causing injury on head, on the pretext that informant wants his forged handicap certificate verified, further Soni kumari also assaulted by lathi causing injury on head of his son, while Chandra Shekhar

Patna High Court CR. MISC. No.42702 of 2026(2) dt.09-07-2026 2/3 Kalplata took out of Rs. 1000/- and chain of his son and accused also assaulted him causing injury on head.

Learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in the instant case by the informant, it is further submitted that dispute is brewing in between the side of the petitioner and the informant since 2014 and informant has been implicated in more than five cases, it is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that allegation of assault on head has been opined to be simple in nature though the second injury that is on left elbow has been opined to be grievous in nature, but then the same is on nonvital part of the body, it is next submitted that from side of the petitioner also Pipra Case No. 93 of 2026 has been instituted against the informant and his side, it is also submitted that even petitioner was assaulted brutally by informant and his side leading to grievous injury and in support of the same, photograph of the petitioner is annexed as Annexure- P/4 along with the injury report.

5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant opposes the anticipatory bail application, but then are not in a position to rebut the

No.42702 of 2026(2) dt.09-07-2026 3/3 submission of the learned counsel appearing on behalf of the petitioner that injury suffered by the injured on head has been opined to be simple in nature and from side of the petitioner also Pipra P.S. Case No. 93 of 2026 has been instituted against the informant and his side and petitioner and others have also suffered injury.

Considering the submissions and taking into consideration the fact that petitioner, above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pipra P.S. Case No. 93 of 2026 subject to the conditions as laid down under Section 482 (2) of the BNSS.
