JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2016 Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 323, 372, 347, 120B of the Indian Penal Code.

The prosecution case is that on 16.04.2015 at 8:00 P.M the minor daughter of the informant Kanchan Kumari was abducted by the petitioner and her son Mintu Kumar and subsequently on the pressure of the villagers the petitioner handed over the victim to the informant. The victim in her 164 Cr.P.C statement has stated that she was being forcefully taken by the petitioner and her son.

It is submitted by learned counsel for the petitioner that daughter of the informant was in love with the son of the petitioner, hence maliciously the accusation has been levelled. For the initial occurrence of 16.04.2015 the F.I.R was registered on 02.06.2015.

No.25377 of 2016 (2) dt.22-06-2016 2/2 Considering the thrust of accusation against the son of the petitioner and petitioner being lady, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Khagaria(Gangaur) P.S. Case No. 352 of 2015, G.R. No. 1411 of 2015, pending in the Court of learned Chief Judicial Magistrate, Khagaria.

With the observations above, the application stands disposed off.
