The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 22.04.2017 passed in Cr. Misc. No. 3478 of 2017, on the ground that the petitioner is in custody since 28.07.2016, there is no progress in the trial and recently charges have been framed. Other co-accused Manish Kumar, Rahul Kumar and Hare Ram Yadav have been allowed bail and as such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of bail by submitting that the name of the petitioner has been taken in the statement of Raj Kumar Goswami recorded under Section 164 Cr.P.C. and further the petitioner has confessed his guilt also.
Patna High Court Cr.Misc. No.44853 of 2017(2) dt.04-10-2017 2/2 In the facts and circumstances stated above, finding no good ground for reconsideration of the prayer of bail, again his such prayer stands rejected in connection with Jehanabad P. S. Case No. 296 of 2016.
However, learned trial court is directed to expedite the trial and conclude the same as early as possible, preferably within six months from the date of receipt/production of a copy of this order, failing which the petitioner, if at no fault, may be at liberty to renew his prayer of bail.
