1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 147, 354 and 488 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that a jointness application, in compliance of the order dated 21.02.2024, has been filed as the notice on behalf of O.P. No. 2 was received by her son.

4. In view of the fact that jointness application has been filed, the notice is deemed to have been validly served.

No.43678 of 2023(7) dt.30-04-2024 2/3 falsely implicated in the instant case by the complainant with an allegation that on 13.09.2020 at 10:00 PM while the complainant along with her three unmarried daughters were going to sleep when the accused persons including the petitioner came variously armed and Jainath Rai broke the door with his legs and entered the house and pointed country made pistol on the temporal region of the complainant, on which she started weeping when her three unmarried daughters came out of the house when Bhagwat, Guddu and Rinku started teasing them and even tried to outrage their modesty, but on alarm the accused fled.

6. The learned counsel for the petitioner further submits that the allegation does not inspire confidence and appears to be cryptic and vague and at the same time is general and omnibus in nature. It is also submitted that no specific allegation is alleged against the petitioner and the petitioner and the informant are related and are having dispute relating to land.

7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

8. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court

No.43678 of 2023(7) dt.30-04-2024 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 1765 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
