====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Runnisaidpur P.S. Case No. 217 of 2021 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code 1860, Sections 25(1-b)a, 26 and 35 of the Arms Act. The allegation, as per the First Information Report, is that the Police got secret information that some miscreants have assembled in an orchard, proceeded towards the place of occurrence and upon seeing the Police party, they started fleeing away. However, the petitioner along with another accused person was arrested and one loaded pistol was recovered from

Patna High Court CR. MISC. No.51620 of 2021(2) dt.15-04-2022 2/2 possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of suspicion and he has got no criminal antecedent. He further submits that the petitioner is in custody since 4.4.2021 and charge sheet has already been submitted.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent, he is in custody since 4.4.2021, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate I/C, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 217 of 2021.
