The petitioner apprehends his arrest in Kharagpur P.S. case No. 185 of 2016 registered under Section 341, 323, 504, 308/34 of the IPC.
The gist of the allegation is that petitioner requested his wife to provide him food as he had to go Munger but his wife did not prepare the meal. On such, the petitioner is alleged to have assaulted his wife with Lathi on her head. Other accused persons are also alleged to have assaulted the informant. The learned counsel for the petitioner submits that there is only one injury on the head of informant which is simple in nature. Informant is wife of the petitioner. Some altercation took place for cooking meal in which his wife fell down and got simple injury on her head.

No.39460 of 2019(2) dt.27-06-2019 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that informant is wife of the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Munger in connection with Kharagpur P.S. case No. 185 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
