ANJANA MISHRA ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Belchhi P.S. Case No. 24 of 2015 for the offences registered under Sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioner is named in the first information report alongwith other accused persons, this court in another case arising out of the same police station has considered the matter at length and after perusal of the case diary has been pleased to extend the privilege of anticipatory bail to the petitioner of that case vide order dated 11.01.2016 passed in Cr. Misc. No. 54867 of 2015. The said order has been annexed in the present application as Annexure-2 series. It is further submitted that the case of the present petitioner is also identical and as such, the present petitioner may also be extended the same privilege.

No.25267 of 2016 (3) dt.26-10-2016 Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Barh in connection with Belchhi P.S. Case No. 24 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
