JUSTICE RAMESH KUMAR DATTA ORAL ORDER 02-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner prays for anticipatory bail in a case under Sections 341,406,420 and 504/34 of the Indian Penal Code. It is submitted by learned counsel for the petitioner that among the two main other accused persons in whose Bank Accounts the money was allegedly deposited, accused Md. Siraj has been granted bail by this Court by order dated 26.5.2015 passed in Cr. Misc. No. 12268 of 2015, whereas accused Md. Imtyaz has been granted anticipatory bail by order dated 29.7.2015 passed in Cr. Misc. No. 29802 of 2015. It is further submitted that there is no allegation that any amount was paid to the petitioner or deposited in his Bank Account nor he has

Patna High Court Cr.Misc. No.43140 of 2015 (2) dt.02-11-2015 2/2 made any claim that he has any approach with the Railway Recruitment Authority and he has been falsely implicated because he used to visit the other two accused persons at the clinic and for other reasons.

On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Pappu Tanti, in the event of his arrest/surrender in the Court below within a period of four weeks from today, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barauni (Refinery) P.S. Case No. 407 of 2014 to the satisfaction of the Chief Judicial Magistrate, Begusarai, subject to the other conditions as laid down under Section 438(2) Cr.P.C.
