2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 338, 336(3), 340(2), 303(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023 and section 66 (C) and 66 (D) of the IT Act.

3. As per the prosecution case, on petitioner's inducement informant deposited money in FINO bank. Later on, it was disclosed that the petitioner fraudulently withdrew Rs.9 lacs of the informant, closed the bank and fled away.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Supplementary affidavit has been filed on behalf of the petitioner. Learned counsel for the petitioner submits that, without admitting his guilt and without prejudice to his right and contention, petitioner is ready to deposit Rs. 9 lacs in instalments in the Nazarat of the concerned Civil Court, subject to outcome of the case.

5. Considering the aforesaid facts of the case, prayer

Patna High Court CR. MISC. No.40778 of 2025(3) dt.12-09-2025 2/2 for bail of the petitioner is allowed. petitioner, mentioned above, is directed to be enlarged on provisional bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Motihari, East Champaran in connection with Motihari (Cyber) Police Station Case No. 43/2024 on following conditions:- (i) At the time of furnishing bail bond, Rs.1 lac shall be deposited by the petitioner in the Nazarat of the Court below and its receipt shall be submitted at the time of filing bail bonds. (ii) Rest amount of Rs. 8 lacs shall be deposited by the petitioner in 12 equal installments in 12 months thereafter. (iii) If the petitioner complies with these conditions, his provisional bail shall be confirmed, and if he fails to comply with the conditions, court below shall be at liberty to cancel the bail bonds of the petitioner.

6. It is made clear that without going into the merit of the case, aforesaid order has been passed only for the purpose of grant of bail and this deposit would be subject to the final result of the criminal case.
