The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 188, 353, 171/34 of the Indian Penal Code and 132/135 of Representation of People Act.

The prosecution case as per the informant being Presiding Officer of Booth No. 33 situated at Upgraded Middle School, Imaliya during Panchayat Elections, 2016 is that on 10.05.2016 at 3.30 P.M. the petitioner entered into the polling booth and after taking ballot paper tore the same and raised alarm as a result the polling process was interrupted. In the whole episode the petitioner was assisted by his friend Brajesh Kumar.

No.27125 of 2016 (2) dt.04-07-2016 2/2 It is submitted by learned counsel for the petitioner that the accusation has been levelled since the petitioner made protest against bogus voting. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Pali P.S. Case No. 19 of 2016 pending in the court of learned Additional Chief Judicial Magistrate-4, Jehanabad.
