JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-02-2021 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State. The petitioners are in custody in connection with Paliganj P.S. Case No. 138 of 2019 registered for the offences under Sections 498(A), 304(B), 201, 34 of the Indian Penal Code.

In view of the order dated 09.02.2021, learned counsel appearing on behalf of the petitioners, after instructions from his clients, submits that his clients are ready to deposit Rs. 5,00,000/-(Five Lakhs)

Patna High Court CR. MISC. No.38764 of 2020(3) dt.19-02-2021 2/3 in fixed deposit scheme in favour of their granddaughter (daughter of the deceased). However, they need some time for arrangement of the amount. In view of the above, this Court is inclined to grant provisional bail to the petitioners.

Let the petitioners, above named, be released on provisional bail for a period of four months from today on their furnishing bail bonds of Rs. 50,000/- (Rupees fifty thousands) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Danapur, Patna in connection with Paliganj P.S. Case No. 138 of 2019. The provisional bail of the petitioners will be confirmed by the learned Court below on receipt of the deposit of Rs. 5,00,000/-(Five Lakhs) in fixed deposit scheme in favour of their grand-daughter (daughter of the deceased) within a period of four months from today.
