JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the State. Petitioner is an accused in Bihta P.S. Case No. 267 of 2017 for an offence under sections 399, 402 and 414 of the Indian Penal Code and Section 25(1-b)A, 26, 35 of Arms Act. The petitioner is in custody since 25.4.2017. Counsel for the petitioner submits that similarly circumstanced other co-accused have been granted bail by this Hon'ble Court including Arun Kumar from whose possession two live cartridges and one loaded country made pistol was recovered whereas from the possession of the petitioner only one live cartridge was recovered and as such he submits that the case of the petitioner is better than Arun Kumar who has already been granted bail.

Patna High Court Cr.Misc. No.44062 of 2017 (2) dt.19-09-2017 2/2 Considering the fact that similarly circumstanced other co-accused including Ranjan Kumar vide order dated 19.8.2017 in Cr. Misc. No. 38822 of 2017 and Saheban Kumar @ Saheban Yadav has been granted bail vide order dated 23.8.2017 in Cr. Misc. No. 40048 of 2017 and Arun Kumar has been granted bail in Cr. Misc. No. 41864 on the ground of parity, the court is inclined to enlarge the petitioner named above on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-I, Danapur or the successor court in connection with Bihta P.S. Case No. 267 of 2017 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses.
