The petitioners apprehend their arrest in Bettiah Muffasil P.S. Case No. 129 of 2021, registered for the offences punishable under Sections 379, 323 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that on the alleged date and time of occurrence, all the accused persons including petitioners entered into the house of informant and with the help of poclain machine damaged the house and other articles and

It is submitted that petitioners have been falsely implicated in this case due to land dispute between the parties. There is case and counter case. Present case is counter blast of Bettiah Muffasil PS Case No. 534 of 2020 and Bettiah Muffasil of 598 of 2020 lodged by petitioner nos. 3 and 4 against the informant side and only with a view to save their skin this false case has been lodged against petitioners and others. Considering the facts aforesaid and the fact that there is land dispute between the parties, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Muffasil P.S. Case No. 129 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
