The petitioner is in custody since 12.07.2017 in connection with Sour Bazar P.S. Case No. 201 of 2017 for the offence registered under Sections 341, 323, 324, 307, 379, 504, 354 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there was some altercation between the parties over a trivial issue which has resulted in the assault being made on the informant with a spade. The allegations are general and omnibus. There is case and counter case between the parties being Sour Bazar P.S. Case No. 202 of 2017 for the same occurrence.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.40795 of 2017 (2) dt.19-09-2017 2/2 the case and that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 201 of 2017. (Anjana Mishra, J) Jagdish/- U T
