JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. This petition has been filed for modification of order dated 03.02.2010 passed in Cr. Misc. No. 1581 of 2010. Submission on behalf of the petitioner is that petitioner filed Cr. Misc. No. 1581 of 2010 and he was granted bail in connection with Paliganj P.S. Case No. 90 of 2005 vide order dated 03.02.2010 but due to typing error, the father's name of petitioner was mentioned as Parma Yadav in order dated 03.02.2010 passed in above stated Cr. Misc. No. 1581 of 2010 in place of Raj Ballam Yadav and for release of the petitioner from jail custody, the above stated modification is essential. The original record of Cr. Misc. No. 1581 of 2010

Patna High Court Cr.Misc. No.30823 of 2016 (2) dt.09-08-2016 2/2 has been placed before me and I find that original petition of Cr. Misc. No. 1581 of 2010 has already been destroyed in accordance with the rules but the original order passed in the aforesaid Cr. Misc. No. 1581 of 2010 is still available on the record. The aforesaid order dated 03.02.2010 goes to show that father's name of the petitioner has been typed as Parma Yadav in place of Raj Ballam Yadav.

In view of the aforesaid facts and circumstances, this modification petition stands disposed of with direction to Additional Chief Judicial Magistrate, Danapur, Patna/concerned court to read the father's name of petitioner as Raj Ballam Yadav in place of Parma Yadav in connection with Paliganj P.S. Case No. 90 of 2005.
