2. The petitioner seeks bail in a case registered for the offence punishable under Section-30(a) of Bihar Prohibition and Excise (Amendment) Act.

3. Allegedly, on the tip off, the informant along with police personnel reached at the place of occurrence and the petitioner was arrested with 60 litres of country-made liquor.

4. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It has been submitted on behalf of the petitioner that nothing has been recovered from possession of the petitioner. It has further been submitted that as a matter of fact, the petitioner had gone to

Patna High Court CR. MISC. No.46737 of 2024(2) dt.09-07-2024 2/2 meet with relatives as Nawanagar and on the way, an altercation took place between the police and the petitioner and that is why, the petitioner has been implicated in this case. The petitioner is in custody since 02-05-2024.

5. On the otherhand, learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances specially the clean antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Special Judge, Court No. 2, Buxar in connection with Nawanagar (Sonbarsha) P.S. Case No. 142 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
