The petitioner apprehends his arrest in connection with Kanti P.S. Case No.280 of 2015 registered under Section 304 of the Indian Penal Code, pending in the court of SDJM (West), Muzaffarpur.

The accusation is that on 24.06.2015, the informant alongwith his cousin brother was going to Muzaffarpur on a motorcycle. When they reached at village-Harpur Machiya, one person negligently turned his bamboo on the road which caused blood oozing injury on the neck of his cousin brother Antim Kumar Singh and he fell down on the earth. Patna High Court Cr.Misc. No.31299 of 2016 (3) dt.24-08-2016 2/2 there disclosed the name of that person as Md. Hannan (petitioner), who had taken the bamboo to construct a gumti in the Government land.

Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the court below within four weeks from today and pray for bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
