Petitioner seeks bail in Ram Krishna Nagar P.S.Case No.23 of 2018 registered for the offences under Sections 302/34 of the I.P.C. and Section 27 of the Arms Act.

Allegation against three accused persons out of nine is of indiscriminate firing upon the brother of the informant causing his death.

Submission of the learned counsel for the petitioner is that except the petitioner is said to be associate of the assailants there is no allegation of firing against him and he is in jail custody since 12.2.2018.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.46646 of 2018 (4) dt.17-09-2018 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the A. C.J.M. -cum-Sub-Judge XIII, Patna, in Ram Krishna Nagar P.S.Case No.23/18 subject to the conditions and (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
