The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case as per F.I.R is that when the informant was feeding the cattle, all the F.I.R named accused persons including the petitioner came and made indiscriminate firing upon the informant due to which he sustained gunshot injuries on his right wrist and right upper abdomen and became unconscious.
Patna High Court CR. MISC. No.51351 of 2021(3) dt.11-08-2022 2/3 It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner and the informant are agnates and in the background of some land dispute, this false case has been registered against the petitioner. There is general and omnibus allegation against the petitioner. Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted after perusal of the case diary that the witnesses have supported the prosecution case and the injury report of the injured suggests that he sustained fire arm injuries.
Considering the aforestated facts, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
The petitioner is directed to surrender before learned Court below within a period of four weeks from today and pray for regular bail. The Court below may consider the prayer for bail of the petitioner and pass
Patna High Court CR. MISC. No.51351 of 2021(3) dt.11-08-2022 3/3 appropriate order without being prejudiced by the order of this Court.
