JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under section 379 of the Penal Code for committing theft of generator from a Pick-Up Van.

It is alleged that the generator has been recovered from coaccused Santosh Rai who took petitioner's name. Further more, some recovery was made from the house of co-accused Rajesh Paswan.

Considering the facts and circumstances of the case, the petitioner Badal Rai @ Badal Kumar is directed to be released on anticipatory bail, in the event of his arrest/surrender, in connection with Hajipur Sadar P.S. Case No.216 of 2015 on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at
