JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner prays for anticipatory bail in connection with Baheri P.S. case no. 75 of 2016 registered for the offence punishable under Sections 188, 120B/34 of the Indian Penal Code and Section 47(G) of Excise Act.

It has been submitted on behalf of petitioner that except suspicion, there is nothing against the petitioner and the recovery is from the brick kiln and co-accused Basant Chaudhary @ Basant Kumar and Pappu Singh having similar allegations, have already been granted anticipatory bail vide order dated 05.09.2016 passed in Cr. Misc. no. 29098 of 2016 and order dated 01.09.2016 passed in Cr. Misc. no. 26718 of 2016 respectively.

Having heard both sides. In view of the fact that other similarly situated co-accused have already been granted anticipatory bail by a co-ordinate Bench of this Court, let the petitioner Ashutosh Jha @ Ashutosh Kr. Jha, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-V, Darbhanga in connection with Baheri P.S. case no. 75 of 2016 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
