The petitioner seeks bail in Chakand P.S. Case No. 124 of 2018, registered for the offence under Section 302 / 34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, while the informant and his grandson Bindu Yadav (nati) were having talks in their courtyard, the FIR named accused persons arrived there and opened fire on the grandson of informant, as a result of which, the grandson of informant succumbed to the injury. Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation. It is further submitted that FIR named accused persons namely Sunil Yadav, Bare Yadav and Chhote Yadav have already been granted bail by this Court, vide order dated 20.11.2019 passed in

Patna High Court CR. MISC. No.52498 of 2021(2) dt.30-11-2021 2/2 Cr.Misc. No. 61562 of 2019 and order dated 18.12.2019 passed in Cr.Misc. No. 59212 of 2019 (Annexure 2 series). Petitioner has got clean antecedent and he is in custody since 23.06.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VI, Gaya in connection with Chakand P.S.
