JUSTICE RAKESH KUMAR ORAL ORDER 04-07-2016 Heard Sri Narendra Kumar, learned counsel for the petitioner and Sri Anuj Kumar Srivastava, learned A.P.P. The sole petitioner, apprehending his arrest in connection with Manjhi P.S. Case No. 180 of 2015 registered for offence under section 302, 201/ 34 of the Indian Penal Code has prayed for grant of anticipatory bail.

By way of referring to the F.I.R. it was submitted by learned counsel for the petitioner that only on suspicion petitioner was made accused. He has further placed reliance on Annexure -2 and 3 to the present petition and submits that out of three accused persons who were named as F.I.R. named accused,

Patna High Court Cr.Misc. No.26583 of 2016 (2) dt.04-07-2016 2/3 two have already been extended the privilege of anticipatory bail. He further submits that even before the court below despite repeated adjournments case diary was not produced. Keeping in view the fact that out three F.I.R. named accused, two have already been extended the privilege of anticipatory bail as well as the fact that petitioner was made accused on doubt, there is no reason to deny the prayer for anticipatory bail. Accordingly in the event of arrest or surrender within a period of six weeks from today, let the petitioner Manoj Yadav be enlarged on bail on furnishing bail bond of Rs.

10000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate cum Sub Judge V, Saran at Chapra in connection with Manjhi P.S. Case No.

Patna High Court Cr.Misc. No.26583 of 2016 (2) dt.04-07-2016 3/3 case shall stand automatically cancelled and petitioner will have to surrender and make a prayer for regular bail. (Rakesh Kumar, J) Praful/- U T
