The petitioner apprehends his arrest in connection with Udakishunganj P.S. Case No. 72 of 2006 registered for the offence under Sections 302/34 of the Indian Penal Code. Considering the materials available on record and the submission advanced on behalf of the respective parties as well as the nature of allegation against the petitioner supported by the charge sheet submitted by the police after investigation coupled with the fact that processes of Sections 82 and 83 Cr.P.C. have been issued and the petitioner has been declared absconder, this Court is of the opinion that
