I.A. No. 2306 of 2014 The present application has been filed for expunging the names of the deceased petitioner No. 3, 4 and 5 from the array of parties and to substitute the heirs of the deceased petitioners No. 3 and 4 at their place.

The petitioner No. 3, namely, Devendra Singh, who died on 09.02.2010 leaving behind his widow, three sons and four daughters as his heirs and legal representatives whose names and address are mentioned in paragraph No. 2 of the present interlocutory application.

The petitioner No. 4, namely, Ram Prasad Singh, who died on 31.12.2009 leaving behind his widow, a son and four daughters as his heirs and legal representatives whose names and address are mentioned in paragraph No. 3 of the present

So far as petitioner No. 5 (Most. Rampari Devi) is concerned, she died on 04.04.2008 leaving behind her heirs who are already on record as Petitioners No. 6 to 10. In view of the above, petitioner No. 3, namely, Devendra Singh, who died on 09.02.2010, be substituted and in his place, the names of his legal heirs and representatives be added as mentioned in paragraph No. 2 of the present interlocutory application and also Petitioner No. 4, namely, Ram Prasad Singh, who died on 31.12.2009, be substituted and in his place, the names of his legal heirs and representatives be added as mentioned in paragraph No. 3 of the present interlocutory application. However, the legal heirs of petitioner No. 5 (Most. Rampari Devi) who died on 04.04.2008 are already on record as Petitioners No. 6 to 10.

The interlocutory application is, accordingly, allowed (Sandeep Kumar, J) Saif/- U
