JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 27-06-2016 In view of the defects pointed out by the stamp reporter, learned counsel for the appellant Mr. Arun Kumar Rai seeks leave to withdraw the present application in order to file an appropriate appeal before the Division Bench of this Court under the proviso to Section 372 of the Code of Criminal Procedure (for short "CrPC).

Leave is granted.

The application is disposed of as withdrawn.

The appellant would be at liberty to file another application under the proviso to Section 372 of the CrPC before this Court in the same subject matter.

Regard being had to the facts and circumstances of the case, in case a true photo stat copy of the certified copy of the impugned judgment and order is filed on behalf of the appellant,
