JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioner seeks regular bail in connection with Dhamdaha P. S. Case No. 201 of 2015 registered for the offences punishable under Sections 363, 364, 366-A, 120B, 34 of IPC.

As per F.I.R. there is allegation of kidnapping of minor daughter of the informant by the petitioner. Submission of the learned counsel for the petitioner is that the girl has returned with her father and on the pressure of her father she made allegation of kidnapping against the petitioner, but no any other overt act has been mentioned either under Section 161 Cr.P.C. or under Section 164 Cr.P.C. It appears that she has gone on her own sweet will. Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that the girl is minor and the Medical Board also shows the same.

Patna High Court CR. MISC. No.43721 of 2019(4) dt.04-02-2020 2/2 Having heard both sides, in view of the submissions, made above, I am not inclined to grant bail to the petitioner at this stage. However, once the charge has been framed in this case, petitioner is at liberty to renew his prayer for bail. With the above observations, this application is dismissed.
