JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 2 13-07-2021 As prayed for, through video conferencing, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide it's note, dated 23.12.2020, within four weeks of starting of the Court proceeding in physical mode properly. Heard the parties through video conferencing. The petitioner seeks pre-arrest bail in connection with Hussainganj P.S. Case No. 111 of 2020, registered under Sections 341, 323, 379, 354, 504, 34 of the Indian Penal Code. The accusation is that the informant, Bhavnath Yadav, performed the marriage of his daughter with Suresh Yadav, son of Govind Yadav, of village Machakana, P.S. Hussainganj, district Siwan, on 03.04.2020.

Patna High Court CR. MISC. No.38996 of 2020(2) dt.13-07-2021 2/2 started to abuse and scuffle and laid her daughter, catching her hair, on ground, while the in-laws of his daughter were present there, but, they did not make protest.

Submission is that petitioner and others, accused named in the first information report, are co-villagers of the father-in-law of the daughter of the informant, Bhavnath Yadav, and at the instigation of father-in-law of daughter of informant, the informant has lodged the present case with false allegation. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of arrest/surrender, within a period of four weeks from today, in connection with Hussainganj P.S. Case No. 111 of 2020 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
