2. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 87, 96, 352, 351(2) and 3(5) of the B.N.S.
3. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in the instant case with an allegation that he along with other accused persons were instrumental in kidnapping the daughter of the informant. It is next submitted that statement of the victim was recorded under Section 183 of the B.N.S.S. wherein she has not supported the case of the prosecution rather has stated that she asked her father for money on which he slapped her and on account of which she left the home being aggrieved and went to Nawada and from there she
Patna High Court CR. MISC. No.40514 of 2025(3) dt.02-09-2025 2/2 went to Gaya and from there to Prayagraj on her own.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner but then is not in a position to rebut the submission of learned counsel for the petitioner after perusing the case diary that the victim has not supported the case of the prosecution.
5. Considering the submissions made by learned counsel for the petitioner, let petitioner, above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Warisaliganj P.S. Case No. 51 of 2025, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S. (Satyavrat Verma, J) Sanjay/- U T
