JUSTICE ARUN KUMAR ORAL ORDER 06-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 23.5.2018, seeks bail in Phenhara PS Case No. 21 of 2018 registered under Sections 379, 411, 412, 413, 414, 420, 465, 467, 468 and 34 of the IPC. The allegation in brief is that the petitioner was apprehended with the stolen motorcycle along with two live cartridges and empty magazine from his house and he has also one criminal antecedent of dacoity.
Learned Counsel for the petitioner submits that there is no recovery of motorcycle from his conscious possession as he was only crossing the road, the motorcycle was parked and false accusation was made against him.
Having considered recovery of stolen motorcycle from possession of the petitioner as well as two live cartridges from his house presently the prayer for bail of the petitioner is rejected. However the petitioner shall be at liberty to renew the prayer for bail after six months of framing of the charge if the trial does not conclude by that time.
