====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-11-2021 Heard the learned Advocate for the petitioners and the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Ahiyapur P. S. Case No.450 of 2020, instituted for the offences under Sections 341, 323, 324, 325, 308, 447, 379, 504/ 34of the Indian Penal Code. The learned counsel for the petitioners, at the outset, submits that petitioners are persons with clean antecedents and the present case has been instituted as a counter-blast of Ahiyapur P. S. Case No.449 of 2020 instituted by Vinod Thakur (petitioner no.1). It is further submitted that the petitioners and the informant are agnates and both parties have filed a compromise petition before the Court below stating that they are not willing to pursue any further.

Patna High Court CR. MISC. No.60 of 2021(2) dt.01-11-2021 2/2 Learned A.P.P. opposes the bail application, but fairly submits that the petitioners and the informant have entered into a compromise and as such, the learned Court below be directed to verify the same.

In the meantime, the petitioners, above-named, on their surrendering before the learned Court below on 30.11.2021, are directed to be released on provisional bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P. S. Case No.450 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The Court below shall simultaneously issue notice to the informant of the case herein and verify from him whether case has been compromised or not. If the Court below will be satisfied that the parties have compromised the case without any undue pressure, then in that event, the provisional bail shall be confirmed.
